1. Who we are
Atlas Lawns & Gardens provides lawn and garden services across the Blue Mountains, primarily Leonay to Katoomba and surrounds. By using our website, requesting a quote, or booking a service, you agree to these Terms & Conditions.

2. Definitions

We/Us/Our: Atlas – Lawns & Gardens.

You/Your: The client (homeowner, landlord, agent or representative).

Services: Lawn mowing & edging, hedging & pruning, general garden tidy-ups, green-waste removal, pressure washing, and gutter cleaning (single-storey & accessible two-storey), and any other work listed in a quote. ​

3. Using this website
Information on this website is general and may change without notice. We try to keep it accurate but do not guarantee availability or completeness. Links to other sites are provided for convenience only.

4. Quotes, acceptance & validity

Quotes are valid for 14 days unless stated otherwise.

You may accept a quote via our Xero “Accept” button or by written confirmation (email/SMS) referencing the quote number.

Acceptance confirms you have authority to engage us and agree to these Terms.

5. Scope of work & variations
​

The scope is limited to the items listed in the quote.

Variations (e.g., additional tasks, concealed conditions such as excessive overgrowth, debris in lawns, difficult access, or extra waste) will be agreed in writing and charged at [hourly rate]/hr plus materials and waste/disposal at [waste rate]/m³ (or a revised fixed price).

If unexpected conditions make the job unsafe or materially different, we may pause to agree next steps and pricing.

6. Scheduling, access & site conditions

We’ll confirm a service window after acceptance. Dates remain subject to weather and prior jobs.

You must ensure safe and timely access (keys/codes/lockboxes) and secure any pets. We’re not responsible for escapes due to faulty gates or latches.

Work at height is performed only where safe and compliant (typically single-storey and accessible two-storey gutters unless otherwise stated).

Reasonable use of on-site water and power is assumed. Necessary parking/tolls may be charged at cost.

7. Safety, weather & limits of service

For safety (wet/icy conditions, bees/wasps, sharps/asbestos, unstable structures) we may pause or reschedule.

Pressure washing: Results vary with age, porosity and staining; rust/efflorescence/tannin may not fully lift. Fragile/oxidised surfaces may limit outcomes.

Gutter cleaning & ladder work: Performed only with safe ground and access.
-
We do not handle asbestos, hazardous waste, chemical spills or pest control.

8. Green-waste, materials & disposal

Green-waste removal is [included / excluded] in your quote. If excluded, disposal can be added at [waste rate]/m³ plus tip fees.

Plant replacements, specialty chemicals and hard-to-access areas are excluded unless expressly included in the quote.

9. Photos, records & marketing
​

We may take before/after photos for job records and to accompany invoices on request.

We will only use photos for marketing with your consent (or your agency’s consent), and we avoid identifying information such as street numbers.

10. Insurance & liability
​

We hold Public Liability Insurance of $10,000,000 (certificate available on request).
-
We take care around plants and property; however, we are not liable for pre-existing damage, concealed items (e.g., irrigation, cables, rocks in lawns), or defects outside our control.

To the extent permitted by law and subject to your rights under the Australian Consumer Law (ACL), our liability is limited to the re-supply of services or payment of the cost of having the services supplied again.

11. Australian Consumer Law (ACL)
Nothing in these Terms excludes, restricts or modifies any consumer guarantees, rights or remedies conferred by the ACL. Where the ACL applies, you are entitled to remedies as provided by law.

12. Pricing, GST & fees

Prices are in AUD.

As at the date of these Terms, Atlas – Lawns & Gardens is not registered for GST and does not charge GST.

If our GST status changes, we will notify you in writing and GST will apply to invoices issued after the effective date of registration (and be shown clearly on those invoices).

Minimum call-out charges, travel outside the stated service area, parking/tolls, and waste fees may apply where relevant and will be disclosed in the quote or variation.

13. Invoicing, payment & late fees

Unless otherwise agreed, we invoice via Xero on completion (or by stage for larger jobs).

Payment method: Bank transfer (EFT) only to the account shown on the invoice.

Payment terms: Due [7] days from invoice date (or EOM + [x] days for approved agency accounts).

We may charge a late fee of [late fee/interest] where payment is overdue, and/or suspend further work until the account is settled.

If we attend but cannot gain access at the booked time, a re-attendance/failed access fee of [re-attendance fee] may apply.

14. Cancellations & rescheduling

Please give at least [24/48] hours’ notice to cancel or reschedule.

Cancellations or changes inside [24/48] hours may incur a [cancellation fee] to cover lost time/slot. Weather-related changes initiated by us will not incur a fee.

15. Service quality & remedies
​

If something was missed, please notify us within 48 hours of completion and we’ll assess promptly.

Living landscapes vary; regrowth and seasonal changes are not defects. Remedies focus on the original scope.

16. Subcontractors
We may use qualified subcontractors where appropriate. We remain responsible for the delivery of services and ensuring appropriate insurances are held.

17. Intellectual property (website & materials)
All content on this website (text, graphics, logos, photos) is owned by us or our licensors. You may not copy, reproduce or distribute website content without written permission, except for personal, non-commercial use.

18. Privacy
We handle personal information in line with our Privacy Policy (see link on the website). We use your details to provide quotes, schedule work, issue invoices and keep necessary records. Access codes/keys provided to us are kept confidential and used only for the agreed service.

19. Force majeure
We are not liable for delay or failure to perform due to events beyond our reasonable control (including severe weather, natural disasters, utility failures, accidents, illness, pandemics, or transport disruptions). We’ll resume as soon as practicable.

20. Disputes & complaints
If you have a concern, please contact us at [Email]. We’ll aim to resolve issues quickly. Nothing in this clause prevents either party from seeking urgent relief where appropriate.

21. Changes to these Terms
We may update these Terms from time to time. The version published on our website at the time you accept a quote or book a service applies to that engagement. Material changes to pricing or GST status will be communicated in writing.

22. Governing law
These Terms are governed by the laws of New South Wales, Australia. Each party submits to the non-exclusive jurisdiction of the courts of NSW.
